Welcome to bigbag®. These Terms and Conditions ('Terms') govern your access and use of our website (Big Bag), mobile applications published in Google Play store, Apple App Store, and other online services (collectively, the 'Services').

These Terms constitute a legal agreement between you (referred to as 'User', 'Vendor', 'you', or 'your') and Ramz Aloula Company for Information Technology ('Company', 'we', 'us', or 'our').

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to all of the Terms, you may not access or use the Services.

2. About bigbag®

bigbag® is an online marketplace that allows retailers to list and sell their goods and enables consumers to buy through a range of platforms, including mobile apps and websites.

We reserve the right to introduce new Services and update or withdraw any of the Services, in our sole discretion, and we will not be liable to you for exercising this discretion.

3. Registration and Account

To use certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

You can register as a buyer or vendor and use the Services if you meet the following requirements:

• For Buyers

  1. you must be at least 18 years old and have the legal capacity to enter into contracts.

  2. In order to be identified, you have to provide your name, phone number, or email.

  3. you may provide an address in Saudi Arabia ('KSA') for the purpose of product delivery within our service area

• For vendors

  1. You are a legal entity duly registered in KSA;

  2. you have a valid trade license;

  3. you provide proof of authorization for the individual who will be registering and using the Site;

  4. you have to provide supporting documents which are required for onboarding in our platform.

4. User Accounts

You may be required to create an account to access and use certain features of the Services. You are responsible for maintaining the confidentiality of your account information, including your password. You are also responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this Section.

5. User obligations

When using or accessing the Services, you agree that you:

• agree to be liable for all activities performed using your account and password, as well as for protecting their confidentiality and restricting access to and use of them;

• commit to notify us immediately of any unauthorized use of your account or password, as well as any other security breach;

6. Vendor Responsibilities

As a vendor on our Platform, you agree to:

• Provide accurate and truthful information about your products or services.

• Fulfill orders promptly and maintain a high standard of customer service.

• Comply with all applicable laws and regulations.

• Not engage in fraudulent activities, including misrepresentation of products or services.

7. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that could harm, disable, overburden, or damage our servers or networks.

• Use the Services to collect or store personal information about other users without their consent.

• Use the Services for any commercial purpose without our express written consent.

• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity.

• Interfere with or disrupt the Services or any other user's use of the Services.

• Violate any applicable laws or regulations in KSA

8. Orders and Payment

• Orders: By placing an order on the Services, you offer to purchase the products or services described in your order at the price listed on the Services. We reserve the right to reject any order, for any reason, at any time.

• Payment: You agree to pay all charges incurred by you or anyone using your account at the prices in effect at the time the order is placed. We accept payment by the methods listed on the Services. We may use third-party payment processors to process your payments.

9. Fees and Payments

Vendor fees and payment terms will be outlined in a separate agreement between the Ramz Aloula Company and the Vendor. We reserve the right to modify fees and payment terms with notice.

10. Returns and Refunds

• 10.1 Policy for Unresponsive Customers

  At order delivery, if the customer does not respond to the delivery agent, the agent will attempt to contact the customer up to three times within a 10-minute period. If the customer remains unresponsive after these attempts, bigbag may leave the order at the doorstep. bigbag will not be held responsible for any loss or damage after the order has been delivered, and no refund will be issued. If the customer chooses to Pickup the order personally from the store and fails to do so, the Refund Policy will apply. In such cases, the customer must contact the concerned store directly.

11. Intellectual Property

You acknowledge and agree that all content and materials available on the Platform, including but not limited to text, graphics, logos, button icons, images, and software, are the property of Ramz Aloula or its licensors and are protected by intellectual property laws

12. Disclaimer

THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

14. Termination

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform or to us.

15. Disclaimer of Warranties

The Platform is provided on an 'as-is' and 'as available' basis. We make no representations or warranties of any kind, express or implied, regarding the use or the results of the Platform in terms of its correctness, accuracy, reliability, or otherwise.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Saudi Arabia ('KSA'). Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the rules of Saudi Arabia.

17. Entire Agreement

These Terms constitute the entire agreement between you and us relating to your use of the Services.

18. Changes to Terms

We may revise these Terms at any time by posting the revised Terms on the Services. Your continued use of the Services after such posting constitutes your acceptance of the revised Terms.
